Terms of Service

Version 1.0 ยท Last updated: 24 September 2026

1. About these terms

These terms are an agreement between you and Paul Eveleigh, trading as Driveway (ABN to be confirmed) ("Driveway", "we", "us"), and cover your use of www.getdriveway.app.

By creating an account you agree to these terms and to our Privacy Policy.

If you don't agree, don't use Driveway.

2. What Driveway is

Driveway is a marketplace. It lets people who own equipment ("hosts") rent it to people who need it ("renters").

Driveway does not own, inspect, store, deliver or maintain any item listed on it. The rental agreement is between the host and the renter. Driveway is not a party to it.

What we do is provide the place to list and book, take the payment, hold the deposit, and pass the host their share.

3. Who can use Driveway

You must:

  • be at least 18 years old
  • be in Australia
  • give accurate details, including a working mobile number
  • keep your login details to yourself

Businesses may use Driveway, as hosts or as renters. If you use Driveway for a business, you are responsible for your own obligations to your customers, including under Australian Consumer Law.

We may suspend or close an account that breaks these terms.

4. Listing an item

As a host, you agree that:

  • you own the item, or are allowed to rent it out
  • your description and photos are accurate and current
  • the item is safe, working, and legal to rent
  • you will keep your availability up to date and honour bookings you accept
  • you will not list anything illegal, stolen, or unsafe

You set your own daily price, deposit, delivery and collection fees, and cancellation policy.

5. Booking an item

As a renter, you agree that:

  • you will use the item as it is meant to be used, and follow the host's instructions
  • you will return it on time, in the condition you got it, minus fair wear and tear
  • you will not lend it on to anyone else
  • you will tell the host straight away if it is damaged, lost or stolen

Photos at pickup and return. Both of you should take photos when the item changes hands. These are the evidence if anything is disputed, and without them a claim is very hard to support.

6. Money

What the renter pays: the daily rate times the number of days, plus any delivery or collection fee.

What Driveway keeps: 13% of the rental amount from the host, and 5% of each delivery or collection fee.

What the host receives: the rest, paid to their nominated account when the host confirms the item has been returned. Read section 9 before you confirm.

Payments are handled by Stripe. Driveway never sees your full card number.

7. The deposit

Before a rental starts, an amount is held on the renter's card. A hold is not a charge: the bank sets the money aside, and it is released when the rental ends without a claim.

A hold does not last forever. Card authorisations expire โ€” often within about five days. If your rental runs longer than that, the hold may expire before the item comes back, and there will be nothing left to claim against. Driveway will tell you when a hold is close to expiring, but it cannot extend one.

Driveway will only charge against a deposit where section 9 allows it.

8. Cancellations

Each listing has a cancellation policy, set by the host and shown before you book.

Under the flexible policy, a renter who cancels more than 24 hours before the rental starts gets a full refund. The 24 hours is measured against the exact start date and time, not the day. Inside that window there is no refund and the host is still paid. If the host cancels, you are refunded in full, whenever that happens.

If a host cancels a confirmed booking, the renter is refunded in full.

9. Damage, loss, and disputes

This is the most important section. Read it before you rent anything out, and before you confirm a return.

Confirming a return pays you, and ends your right to claim

When a host confirms an item has been returned, two things happen at once: the host is paid, and the host's damage claim window closes.

So check the item before you confirm. Once you confirm, you cannot file a damage claim for that rental.

If you have not confirmed, you have 48 hours from the end of the rental to file a claim, with photos.

How a claim is settled

When a host files a claim, the renter is asked to respond. They can:

  • agree the amount, or
  • offer a different amount, which the host can accept, or
  • decline, or do nothing.

Driveway will only take money from a deposit where the host and the renter have agreed the amount. If they agree, we charge that amount and release the rest.

If they do not agree, we release the deposit in full.

Driveway does not decide who is right

We are not a judge, an arbitrator, an insurer or a valuer. We do not investigate claims, assess damage, or take sides. If the two of you cannot agree, the dispute is between you, and either of you may pursue it however you would with anyone else.

The deposit exists to make an honest settlement easy. It is not a guarantee that a host will be compensated.

10. Reviews

After a rental, both sides can leave a review: the renter reviews the item and the host, and the host reviews the renter.

Neither review is shown until both have been submitted, or 14 days have passed โ€” so neither of you is writing in reaction to the other.

A host may reply once to a review of their listing. Reviews cannot be edited once published.

Reviews must be honest and about the rental. We may remove a review that is abusive, contains someone's personal details, or has nothing to do with the rental.

11. What Driveway is not responsible for

To the extent the law allows:

  • We are not responsible for the condition, safety, legality or suitability of any item.
  • We are not responsible for anything a host or a renter does or fails to do.
  • We do not insure any item. If you want your item insured, arrange that yourself.
  • We do not guarantee that any item will be available, that a booking will go ahead, or that Driveway will always be working.

Nothing in these terms excludes any right you have under the Australian Consumer Law that cannot be excluded. Where we are allowed to limit our liability, it is limited to supplying our service again, or refunding what you have paid us in fees.

12. What you are responsible for

You agree to cover us for any loss we suffer because you broke these terms, broke the law, or harmed someone else while using Driveway.

13. Messages and conduct

Messages between hosts and renters go through Driveway. Keep them civil and about the rental. We may read messages where we need to investigate a safety concern or a report of misuse.

Don't use Driveway to harass anyone, to advertise something else, or to arrange a rental off the platform in order to avoid fees.

14. Your content

You keep ownership of your photos and listing text. You give Driveway permission to show them on the platform and to use them to promote Driveway.

Don't upload anything that isn't yours to upload.

15. Closing your account

You can close your account at any time. We may close or suspend yours if you break these terms, or if we reasonably believe you are putting other people at risk.

Closing an account doesn't end obligations already in place โ€” a booking you've agreed to, money you owe, or a claim already filed.

16. Changes to these terms

We may change these terms. If a change is significant we'll tell you in the app or by email and ask you to accept the new version. Continuing to use Driveway after that means you accept it.

17. Law

These terms are governed by the law of New South Wales, Australia.

18. Contact

Questions about these terms: support@getdriveway.app, or through Contact support in the app.
